Léiriú.
1.—San Acht seo ciallaíonn “an Príomh-Acht” an tAcht Ealaíon, 1951.
Comhaltas na Comhairle.
2.—(1) Is iad a bheidh ar an gComhairle cathaoirleach (dá ngairtear an Cathaoirleach ina dhiaidh seo san Acht seo) agus cibé líon comhaltaí eile (nach mó ná sé dhuine dhéag) a chinnfidh an Taoiseach ó am go ham.
(2) Nuair a bheidh daoine á roghnú lena gceapadh mar chomhaltaí den Chomhairle—
(a) tabharfar aird ar earmaise nó ar spéis an duine sna healaíona nó ar a bhfuil d'eolas aige orthu, nó ar a inniúlacht ar shlite eile chun cabhrú leis an gComhairle,
(b) féachfar le cothrom a chinntiú san ionadaíocht amhail idir brainsí de na healaíona.
An Cathaoirleach.
3.—(1) Is é an Taoiseach a cheapfaidh an Cathaoirleach.
(2) Ceapfar an Cathaoireach go ceann cibé téarma a chinnfidh an Taoiseach tráth a cheaptha agus íocfar leis, as airgead a bheidh faoina réir ag an gComhairle, cibé luach saothair agus liúntais a chinnfidh an Taoiseach tar éis dó dul i gcomhairle leis an Aire Airgeadais.
(3) Féadfaidh an Cathaoirleach éirí as a oifig mar chathaoirleach trí litir a bheidh dírithe chun an Taoisigh agus beidh éifeacht ag an éirí as ar an Taoiseach do ghlacadh leis.
(4) Nuair a scoirfidh an Cathaoirleach i rith a théarma oifige mar chathaoirleach de bheith ina chomhalta den Chomhairle, scoirfidh sé an uair sin freisin de bheith ina Chathaoirleach.
Deireadh le téarmaí oifige comhaltaí áirithe den Chomhairle.
4.—(1) Ar bheith caite don lá iomchuí beidh deireadh le téarma oifige, mar chomhalta den Chomhairle, gach duine is comhalta den sórt sin an lá sin.
(2) San alt seo ciallaíonn “an lá iomchuí” an lá díreach roimh an lá a thosóidh téarmaí oifige na ndaoine a cheapfar i 1973 de bhun mhír 4 (1) (a) den Sceideal a ghabhann leis an bPríomh-Acht (a cuirtear isteach ann le halt 13 den Acht seo).
An Stiúrthóir.
5.—Ceapfaidh an Chomhairle ó am go ham, ar cibé téarmaí agus coinníollacha a chinnfidh siad agus faoi réir cheadú an Taoisigh, duine le bheith ina phríomh-oifigeach feidhmiúcháin don Chomhairle, agus an Stiúrthóir a thabharfar ar an duine sin agus is é a ghairtear de san Acht seo agus sa Sceideal a ghabhann leis an bPríomh-Acht (arna leasú leis an Acht seo).
Comhalta den Chomhairle a bheith ina chomhalta de cheachtar Teach den Oireachtas.
6.—(1) Má dhéantar comhalta den Chomhairle a ainmniú mar iarrthóir le toghadh chun ceachtar Tí den Oireachtas nó mar chomhalta de Sheanad Éireann, scoirfidh sé air sin de bheith ina chomhalta den Chomhairle.
(2) Duine a bheidh de thuras na huaire i dteideal faoi Bhuan-Orduithe cheachtar Tí den Oireachtas suí sa Teach sin beidh sé, fad a bheidh sé i dteideal amhlaidh, dícháilithe chun teacht chun bheith ina chomhalta den Chomhairle.
Comhalta den Chomhairle a bheith dícháilithe.
7.—Beidh comhalta den Chomhairle dícháilithe chun oifig a shealbhú agus scoirfidh sé d'oifig a shealbhú mar chomhalta den sórt sin má bhreithnítear ina fhéimheach é nó má dhéanann sé imshocraíocht nó comhshocraíocht le, creidiúnaithe, nó má thugann cúirt dlínse inniúla pianbhreith phríosúnachta nó phianseirbhíse air.
Oifigigh agus seirbhísigh, etc., d'fheidhmiú feidhmeanna na Comhairle.
8.—(1) Féadfaidh an Chomhairle aon chuid dá bhfeidhmeanna a fheidhmiú tríd an Stiúrthóir nó ag an Stiúrthóir nó trí aon chuid dá n-oifigigh nó dá seirbhísigh eile nó acu.
(2) Ní bheidh feidhm ag Acht Choimisinéirí na Stát-Sheirbhíse, 1956, ná ag Achtanna Rialaithe na Státseirbhíse, 1956 agus 1958, maidir le ceapachán mar oifigeach nó mar sheirbhíseach don Chomhairle.
Oifigeach nó seirbhíseach don Chomhairle a bheith ina chomhalta de cheachtar Teach den Oireachtas.
9.—(1) I gcás an Stiúrthóir nó aon oifigeach eile nó aon seirbhíseach i bhfostaíocht faoin gComhairle teacht chun bheith ina chomhalta de cheachtar Teach den Oireachtas—
(a) beidh sé ar iasacht ón bhfostaíocht sin i gcaitheamh na tréimhse (dá ngairtear tréimhse na hiasachta san alt seo) dar tosach an tráth a thiocfaidh sé i dteideal faoi Bhuan-Orduithe an Tí sin suí sa Teach sin agus dar críoch an tráth a scoirfidh sé de bheith ina chomhalta den Teach sin nó, más túisce a tharlóidh, a éireoidh sé as an bhfostaíocht sin nó a scoirfidh sé di nó a fhoirceannfaidh an Chomhairle an fhostaíocht sin,
(b) ní íocfaidh an Chomhairle leis, ná ní bheidh sé i dteideal go bhfaighidh sé ón gComhairle, aon luach saothair i leith tréimhse na hiasachta.
(2) Duine a bheidh de thuras na huaire i dteideal faoi Bhuan-Orduithe cheachtar Tí den Oireachtas suí sa Teach sin beidh sé, fad a bheidh sé i dteideal amhlaidh, dícháilithe chun teacht chun bheith ina Stiúrthóir nó ina aon oifigeach eile don Chomhairle nó ina sheirbhíseach di.
Aoisliúntas d'oifigigh agus do sheirbhísigh na Comhairle.
10.—(1) A luaithe is féidir tar éis dáta an Achta seo a rith, ullmhóidh an Chomhairle, agus cuirfidh faoi bhráid an Taoisigh, scéim ranníocach nó scéimeanna ranníocacha chun pinsin, aiscí agus liúntais eile a dheonú, ar scor dóibh, dá n-oifigigh agus dá seirbhísigh lánaimsire (lena n-áirítear an Stiúrthóir) nó ina leith.
(2) Socróidh gach scéim den sórt sin an tráth scoir agus na coinníollacha scoir do na daoine uile a mbeidh pinsin, aiscí nó liúntais iníoctha leo nó ina leith faoin scéim ar scor dóibh, agus féadfar tráthanna agus coinníollacha éagsúla a shocrú i leith aicmí éagsúla daoine.
(3) Féadfaidh an Chomhairle tráth ar bith scéim do leasú scéim a cuireadh faoi bhráid an Taoisigh agus a ceadaíodh roimhe sin faoin alt seo a ullmhú agus a chur faoi bhráid an Taoisigh.
(4) Déanfaidh an Chomhairle scéim a chuirfear faoi bhráid an Taoisigh faoin alt seo, má cheadaíonn an Taoiseach í tar éis dó dul i gcomhairle leis an Aire Airgeadais, a chur i gcrícn de réir a téarmaí.
(5) Má tharlaíonn aon díospóid maidir le héileamh aon duine ar aon phinsean, aisce nó liúntas is iníoctha de bhun scéime faoin alt seo nó i dtaobh méid an chéanna, cuirfear an díospóid sin faoi bhráid an Taoisigh agus cinnfidh seisean í tar éis dó dul i gcomhairle leis an Aire Airgeadais agus is cinneadh críochnaitheach cinneadh an Taoisigh.
(6) Gach scéim a chuirfear faoi bhráid an Taoisigh agus a cheadófar faoin alt seo leagfar í faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a ceadaithe agus má dhéanann ceachtar Teach, laistigh den lá is fiche a shuífidh an Teach sin tar éis an scéim a leagan faoin bhráid, rún a rith ag neamhniú na scéime, beidh an scéim ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin scéim.
Coistí comhairleacha.
11.—(1) Féadfaidh an Chomhairle aon cheann nó gach ceann de na coistí seo a leanas a bhunú:
(a) coiste a thabharfaidh comhairle maidir le péintéireacht, snoíodóireacht agus ailtireacht,
(b) coiste a thabharfaidh comhairle maidir le ceol,
(c) coiste a thabharfaidh comhairle maidir le drámaíocht, le litríocht agus le scannánaíocht.
(2) Tabharfaidh coiste a bhunófar faoin alt seo (dá ngairfear coiste comhairleach ina dhiaidh seo san alt seo) comhairle don Chomhairle maidir le haon ábhar (is ábhar lena mbaineann eolas agus taithí ar bhrainse de na healaíona ar ina leith a bunaíodh an coiste comhairleach) a n-iarrfar a gcomhairle ina thaobh.
(3) Is iad a bheidh ar choiste comhairleach Cathaoirleach, is duine atá de thuras na huaire ina chomhalta den Chomhairle, agus ochtar gnáthchomhaltaí agus, faoi réir fho-alt (7) den alt seo, beidh na comhaltaí den choiste comhairleach i seilbh oifige go ceann cibé téarma a chinnfidh an Chomhairle tráth a gceaptha.
(4) Nuair a bheidh comhaltaí de choiste comhairleach á gceapadh ag an gComhairle déanfaidh an Chomhairle deimhin de go bhfuil an coiste ionadaitheach don spéis ar fud an Stáit sa bhrainse nó sna brainsí de na healaíona, de réir mar a bheidh, ar ina leith a bhunaítear an coiste.
(5) Féadfaidh an Chomhairle corrfholúntas a líonadh a tharlóidh i measc comhaltaí coiste chomhairligh.
(6) I gcás duine is cathaoirleach ar choiste comhairleach do scor i rith a théarma oifige mar chathaoirleach den sórt sin de bheith ina chomhalta den Chomhairle, scoirfidh sé freisin de bheith ina chomhalta den choiste comhairleach.
(7) Scoirfidh gach duine de chomhaltaí coiste chomhairligh de bheith i seilbh oifige an lá roimh an lá a dhéanfaidh an Taoiseach ceapacháin den chéad uair eile faoi mhír 4 (1) (a) den Sceideal a ghabhann leis an bPríomh-Acht.
(8) Féadfaidh an Chomhairle, tráth ar bith—
(a) comhalta de choiste comhairleach a chur as oifig,
(b) coiste comhairleach a dhíscaoileadh.
Cúnamh ó údarás áitiúil don Chomhairle agus do dhaoine áirithe eile.
12.—(1) Féadfaidh údarás áitiúil chun críocha an Achta Rialtais Áitiúil, 1941, cúnamh a thabhairt le hairgead nó le hábhar nó trí sheirbhísí nó saoráidí (lena n-áirítear seirbhísí foirne) a sholáthar don Chomhairle, nó d'aon duine a bheidh ag eagrú taispeántais nó dálais eile a mbeadh, nuair a sheolfaí é, d'éifeacht aige, i dtuairim an údaráis, spéis an phobail sna healaíona a spreagadh, eolas, dea-mheas agus cleacht ar na healaíona a chur chun cinn, nó cabhrú le caighdeáin na n-ealaíon a fheabhsú.
(2) Is feidhm fhorchoimeádta cúnamh a thabhairt faoin alt seo.
(3) San alt seo ciallaíonn “feidhm fhorchoimeádta”—
(a) maidir le comhairle contae nó le comhlacht toghaí chun críocha na nAchtanna um Bainistí Chontae, 1940 go 1972, feidhm fhorchoimeádta chun críocha na nAchtanna um Bainistí Chontae, 1940 go 1972,
(b) maidir le bardas contae-bhuirge, feidhm fhorchoimeádta chun críocha na nAchtanna a bhaineann le bainistí na contae-bhuirge.
Leasú ar an bPríomh-Acht.
13.—(1) Leasaítear leis seo alt l den Phríomh-Acht trí “scannánaíocht,” a chur isteach i ndiaidh “drámaíocht,”.
(2) Leasaítear leis seo alt 3 (1) den Phríomh-Acht trí “sa Stát nó lasmuigh den Stát” a chur isteach i ndiaidh “is oiriúnach leo,”.
(3) Leasaítear leis seo alt 5 (1) den Phríomh-Acht trí “tar éis dó comhairle a ghlacadh leis an Aire Airgeadais” a chur isteach i ndiaidh “an Taoiseach”.
(4) Leasaítear leis seo an Sceideal a ghabhann leis an bPríomh-Acht—
(a) trí na fomhíreanna seo a leanas a chur in ionad fhomhíreanna (1), (2) agus (3) de mhír 4:
“(1) (a) Déanfaidh an Taoiseach, sa bhliain 1973 agus gach cúigiú bliain chomhleanúnach ina dhiaidh sin, líon nach mó ná sé dhuine dhéag a cheapadh lá áirithe le bheith ina gcomhaltaí den Chomhairle, agus tosóidh téarmaí oifige na ndaoine a cheapfar lá áirithe faoi seo, gach ceann acu, i gcomhthráth cibé lá dá éis sin a shocróidh an Taoiseach chuige sin agus a shonrófar i ngach ceann de na ceapacháin.
(b) I gcás ina ndéanfaidh an Taoiseach, ag déanamh ceapachán dó de bhun chlásal (a) den fhomhír seo, líon is lú ná sé dhuine dhéag a cheapadh le bheith ina gcomhaltaí den Chomhairle, féadfaidh sé, laistigh den tréimhse iomchuí, daoine a cheapadh le bheith ina gcomhaltaí den Chomhairle, ar choinníoll nach mó in aon tréimhse áirithe den sórt sin líon na gceapachán a dhéanfar de bhun an chlásail seo ná an bhreis a bheidh ag sé déag ar an líon daoine a ceapadh de bhun chlásal (a) a dúradh, go deiridh, sular thosaigh an tréimhse.
(2) Faoi réir forálacha an Achta seo agus an Achta Ealaíon, 1973, beidh gach comhalta a cheapfar faoi fhomhír (1) den mhír seo, mura n-éagfaidh sé nó mura n-éireoidh sé as oifig roimhe sin, i seilbh oifige go dtí tosach an lae a thosóidh téarmaí oifige na ndaoine is túisce a cheapfar dá éis sin de bhun chlásal (a) den fhomhír sin.
(3) Má tharlaíonn corrfholúntas i gcomhaltas na Comhairle, déanfaidh an Taoiseach, a luaithe is caothúil, duine a cheapadh chun an folúntas a líonadh agus beidh duine a cheapfar de bhun na fomhíre seo le bheith ina chomhalta den Chomhairle i seilbh oifige go ceann a mbeidh fágtha de théarma a réamhtheachtaí.”;
(b) trí “le comhaltaí seachas an Cathaoirleach” a chur in ionad “le gnáthchomhaltaí” i mír 4 (5);
(c) trí na fomhíreanna nua seo a leanas a chur isteach i ndiaidh fhomhír (5) de mhír 4:
“(6) Féadfaidh comhalta den Chomhairle éirí as a oifig mar chomhalta den sórt sin trí litir a bheidh dírithe chun an Taoisigh agus beidh éifeacht ag an éirí as ar an Taoiseach do ghlacadh leis.
(7) Féadfaidh an Taoiseach comhalta den Chomhairle a chur as oifig.
(8) Sa mhír seo ciallaíonn ‘an tréimhse iomchuí’ an tréimhse dar tosach an lá a socróidh an Taoiseach ag déanamh ceapachán dó faoi fhomhír (1) (a) den mhír seo gurb é an lá é a thosóidh téarmaí oifige na ndaoine a cheapfar an tráth sin agus dar críoch an lá roimh an lá a dhéanfaidh an Taoiseach ceapacháin den chéad uair eile faoin bhfomhír sin.”;
(d) tríd an mír seo a leanas a chur in ionad mhír 6:
“Caiteachais | 6. (1) Íocfar le comhalta den Chomhairle, seachas an Cathaoirleach, as airgead a bheidh faoina réir ag an gComhairle, cibé liúntais i leith caiteachas a chinnfidh an Taoiseach tar éis dó dul i gcomhairle leis an Aire Airgeadais. |
(2) Féadfaidh an Chomhairle, as a gcistí féin, aisíoc a dhéanamh, más oiriúnach leo, le haon chomhalta de choiste comhairleach a bhunófar de bhun alt 11 den Acht Ealaíon, 1973, i leith aon chaiteachas-as-póca a thabhaigh sé mar chomhalta den Choiste.”; |
(e) trí “(i dteannta an Stiúrthóra)” a chur isteach i ndiaidh “seirbhíseach” i mír 8 (1);
(f) trí “(lena n-áirítear an Stiúrthóir) agus gach seirbhíseach” a chur in ionad “agus seirbhíseach” agus trí “agus liúntais” agus “a thabharfar tar éis dó dul i gcomhairle leis an Aire Airgeadais” a chur isteach i ndiaidh “luach saothair” agus “le ceadú an Taoisigh”, faoi seach, i mír 8 (2); agus
(g) trí “an Cathaoirleach” agus “an Chathaoirligh” a chur in ionad “an Stiúrthóir” agus “an Stiúrthóra”, faoi seach, gach áit a bhfuil na focail sin i míreanna 7 agus 9.
Aisghairm.
14.—(1) Aisghairtear leis seo “(sa Stát nó lasmuigh den Stát)” i mír (d) d'alt 3 (1) den Phríomh-Acht.

ARTS ACT, 1973
Interpretation.
1.—In this Act “the Principal Act” means the Arts Act, 1951.
Membership of Council.
2.—(1) The Council shall consist of a chairman (subsequently in this Act referred to as the Chairman) and such number (not being more than sixteen) of other members as the Taoiseach shall from time to time determine.
(2) In the selection of persons for appointment to membership of the Council regard shall be had to—
(a) the person's attainments or interest in or his knowledge of the arts, or his competence otherwise to assist the Council,
(b) securing a balanced representation as between branches of the arts.
Chairman.
3.—(1) The Chairman shall be appointed by the Taoiseach.
(2) The Chairman shall be appointed for such term as shall be determined by the Taoiseach on the occasion of his appointment and shall be paid, out of moneys at the disposal of the Council, such remuneration and allowances as the Taoiseach, after consultation with the Minister for Finance, may determine.
(3) The Chairman may resign his office as chairman by letter addressed to the Taoiseach and the resignation shall take effect on being accepted by the Taoiseach.
(4) When the Chairman ceases during his term of office as chairman to be a member of the Council, he shall also then cease to be Chairman.
Cesser of terms of office of certain members of Council.
4.—(1) The term of office as a member of the Council of every person who on the appropriate day is such a member shall cease on the expiration of that day.
(2) In this section “the appropriate day” means the day which next precedes the day on which the terms of office of the persons appointed in 1973 pursuant to paragraph 4 (1) (a) of the Schedule to the Principal Act (inserted therein by section 13 of this Act) are to commence.
Director.
5.—The Council shall from time to time appoint, on such terms and conditions as they shall determine and subject to the approval of the Taoiseach, a person to be the chief executive officer of the Council, and such person shall be known as and is, both in this Act and in the Schedule to the Principal Act (as amended by this Act), referred to as the Director.
Membership of either House of Oireachtas by member of Council.
6.—(1) When a member of the Council is nominated either as a candidate for election to either House of the Oireachtas or as a member of Seanad Éireann, he shall thereupon cease to be a member of the Council.
(2) A person who is for the time being entitled under the Standing Orders of either House of the Oireachtas to sit therein shall, while so entitled, be disqualified from becoming a member of the Council.
Disqualification of member of Council.
7.—A member of the Council shall be disqualified from holding and shall cease to hold office as such member if he is adjudged bankrupt or makes a composition or arrangement with creditors, or is sentenced by a court of competent jurisdiction to suffer imprisonment or penal servitude.
Performance of functions of Council by officers and servants, etc.
8.—(1) The Council may perform any of their functions through or by the Director or any of their other officers or servants.
(2) The Civil Service Commissioners Act, 1956, and the Civil Service Regulation Acts, 1956 and 1958, shall not apply to an appointment as officer or servant of the Council.
Membership of either House of Oireachtas by officer or servant of Council.
9.—(1) Where the Director or any other officer or any servant in the employment of the Council, becomes a member of either House of the Oireachtas—
(a) he shall during the period (in this section referred to as the secondment period) commencing upon his becoming entitled under the Standing Orders of that House to sit therein and ending either when he ceases to be a member of that House, or, if it should sooner happen, upon his resignation or retirement from such employment or upon the termination of such employment by the Council, stand seconded from such employment,
(b) he shall not be paid by, or entitled to receive from, the Council any remuneration in respect of the secondment period.
(2) A person who is for the time being entitled under the Standing Orders of either House of the Oireachtas to sit therein shall, while so entitled, be disqualified from becoming the Director or any other officer or a servant of the Council.
Superannuation of officers and servants of Council.
10.—(1) As soon as may be after the passing of this Act the Council shall prepare and submit to the Taoiseach a contributory scheme or schemes for the granting of pensions, gratuities and other allowances on retirement to or in respect of their whole-time officers and servants (including the Director).
(2) Every such scheme shall fix the time and conditions of retirement for all persons to or in respect of whom pensions, gratuities or allowances on retirement are payable under the scheme, and different times and conditions may be fixed in respect of different classes of persons.
(3) The Council may at any time prepare and submit to the Taoiseach a scheme amending a scheme previously submitted and approved under this section.
(4) A scheme submitted to the Taoiseach under this section shall, if approved of by him after consultation with the Minister for Finance, be carried out by the Council in accordance with its terms.
(5) If any dispute arises as to the claim of any person to, or the amount of, any pension, gratuity or allowance payable in pursuance of a scheme under this section, such dispute shall be submitted to the Taoiseach who after consultation with the Minister for Finance shall determine it and whose decision shall be final.
(6) Every scheme submitted and approved of under this section shall be laid before each House of the Oireachtas as soon as may be after it is approved of and if either House, within the next twenty-one days on which that House has sat after the scheme is laid before it, passes a resolution annulling the scheme, the scheme shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Advisory Committees.
11.—(1) The Council may establish any or all of the following:
(a) a committee to advise on painting, sculpture and architecture,
(b) a committee to advise on music,
(c) a committee to advise on the drama, literature and the cinema.
(2) A committee established pursuant to this section (in this section subsequently referred to as an advisory committee) shall advise the Council on any matter (being a matter on which knowledge and experience of a branch of the arts in relation to which the advisory committee is established has a bearing) on which their advice is requested.
(3) An advisory committee shall consist of a Chairman, who shall be a person who is for the time being a member of the Council, and eight ordinary members and, subject to subsection (7) of this section, the members of the advisory committee shall hold office for such term as shall be determined by the Council on the occasion of their appointment.
(4) In appointing members of an advisory committee the Council shall, so far as practicable, ensure that the committee is representative of the interest throughout the State in the branch or branches of the arts, as the case may be, in relation to which the committee is established.
(5) The Council may fill a casual vacancy occurring amongst the members of an advisory committee.
(6) Where a person who is chairman of an advisory committee ceases during his term of office as such chairman to be a member of the Council he shall also cease to be a member of the advisory committee.
(7) Each of the members of an advisory committee shall cease to hold office on the day which precedes the day on which the Taoiseach next makes appointments under paragraph 4 (1) (a) of the Schedule to the Principal Act.
(8) The Council may at any time—
(a) remove a member of an advisory committee from office,
(b) dissolve an advisory committee.
Assistance by local authority to Council and certain other persons.
12.—(1) A local authority for the purposes of the Local Government Act, 1941, may assist with money or in kind or by the provision of services or facilities (including the services of staff) the Council, or any person organising an exhibition or other event the effect of which when held would, in the opinion of the authority, stimulate public interest in the arts, promote the knowledge, appreciation and practice of the arts, or assist in improving the standards of the arts.
(2) Assisting under this section shall be a reserved function.
(3) In this section “reserved function” means—
(a) with respect to the council of a county or an elective body for the purposes of the County Management Acts, 1940 to 1972, a reserved function for the purposes of the County Management Acts, 1940 to 1972,
(b) with respect to the corporation of a county borough, a reserved function for the purposes of the Acts relating to the management of the county borough.
Amendment of Principal Act.
13.—(1) Section 1 of the Principal Act is hereby amended by the insertion of “the cinema,” after “drama,”.
(2) Section 3 (1) of the Principal Act is hereby amended by the insertion of “within or without the State” after “as they think fit,”.
(3) Section 5 (1) of the Principal Act is hereby amended by the insertion of “, after consultation with the Minister for Finance,” after “the Taoiseach”.
(4) The Schedule to the Principal Act is hereby amended by—
(a) the substitution of the following subparagraphs for subparagraphs (1), (2) and (3) of paragraph 4:
“(1) (a) The Taoiseach shall, in the year 1973 and in each fifth successive year thereafter, appoint on a particular day not more than sixteen persons to be members of the Council, and the terms of office of the persons appointed hereunder on a particular day shall each simultaneously commence on such subsequent day as shall be fixed for that purpose by the Taoiseach and specified in each of the appointments.
(b) In case the Taoiseach when making appointments pursuant to clause (a) of this subparagraph appoints to be members of the Council less than sixteen persons, he may within the appropriate period appoint persons to be members of the Council, provided that the appointments made pursuant to this clause shall not in any particular such period be greater in number than that by which sixteen exceeds the number of persons appointed pursuant to the said clause (a) last before the period commenced.
(2) Subject to the provisions of this Act and of the Arts Act, 1973, every member appointed under subparagraph (1) of this paragraph shall, unless he sooner dies or resigns, hold office until the beginning of the day on which the terms of office of the persons next appointed pursuant to clause (a) of that subparagraph are to commence.
(3) Where a casual vacancy occurs in the membership of the Council the Taoiseach shall, as soon as conveniently may be, appoint a person to fill the vacancy and a person appointed pursuant to this subparagraph to membership of the Council shall hold office for the remainder of his predecessor's term.”;
(b) the substitution of “members other than the Chairman” for “ordinary members” in paragraph 4 (5);
(c) the insertion of the following new subparagraphs after subparagraph (5) of paragraph 4:
“(6) A member of the Council may resign his office as such member by letter addressed to the Taoiseach and the resignation shall take effect on being accepted by the Taoiseach.
(7) The Taoiseach may remove a member of the Council from office.
(8) In this paragraph ‘the appropriate period’ means the period beginning on the day fixed by the Taoiseach when making appointments under subparagraph (1) (a) of this paragraph as that on which the terms of office of the persons then appointed are to commence and ending on the day which precedes the day on which the Taoiseach next makes appointments under that subparagraph.”;
(d) the substitution of the following paragraph for paragraph 6:
“Expenses
6. (1) A member of the Council, other than the Chairman, shall be paid out of the funds at the disposal of the Council, such allowances in respect of expenses as the Taoiseach, after consultation with the Minister for Finance, may determine.
(2) The Council may out of their funds, if they think fit, reimburse any member of an advisory committee established pursuant to section 11 of the Arts Act, 1973, for any out-of-pocket expenses incurred by him as a member of the Committee.”;
(e) the insertion of “(in addition to the Director)” after “servants” in paragraph 8 (1);
(f) the substitution of “(including the Director) and every servant” for “and servant” and the insertion of “and allowances” and “given after consultation with the Minister for Finance” after “remuneration” and “the Taoiseach”, respectively, in paragraph 8 (2); and
(g) the substitution of “Chairman” for “Director” in each place where that word occurs in paragraphs 7 and 9.
Repeals.
14.—(1) In paragraph (d) of section 3 (1) of the Principal Act “(within or without the State)” is hereby repealed.
(2) The following provisions of the Schedule to the Principal Act are hereby repealed, namely, paragraphs 2, 3 and 5, subparagraph (3) of paragraph 8, and “ordinary” in subparagraph (4) of paragraph 4.
Short title, collective citation and construction.
15.—(1) This Act may be cited as the Arts Act, 1973.
(2) The Principal Act and this Act may be cited together as the Arts Acts, 1951 and 1973, and shall be construed together as one Act.
