LANDLORD AND TENANT (AMENDMENT) ACT, 1989
BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:
Amendment of section 13 of Landlord and Tenant (Amendment) Act, 1980.
1.—Section 13 of the Landlord and Tenant (Amendment) Act, 1980, is hereby amended by the insertion after subsection (2) of the following subsections:
“(3) (a) The occupation by a person or his predecessors in title under a lease or other contract of tenancy of a tenement in the Custom House Docks Area (within the meaning of section 41 of the Finance Act, 1986), being a tenement bona fide used on the commencement of occupation under the lease or contract of tenancy, and expressly authorised or required by that lease or contract to be used, wholly or partly for the purpose of carrying on an activity consisting of or including a relevant trading operation within the meaning of section 39B (inserted by section 30 of the Finance Act, 1987, as amended by section 36 of the Finance Act, 1988) of the Finance Act, 1980, or bona fide used for preparing for the carrying on of such an activity, shall not be regarded as occupation for the purposes of paragraph (a) or (b) of subsection (1).
(b) Where this subsection applies by virtue of paragraph (a) in relation to occupation—
(i) it also applies to occupation under the lease or contract concerned at any time when the tenement concerned is no longer used for the purpose of carrying on an activity aforesaid, and
(ii) it applies in relation to occupation of the whole or part of the tenement under any other lease or contract of tenancy that is in force during the whole or part of the currency of, and is made after the making of, the first-mentioned lease or contract of tenancy.
(4) Subsection (3) shall have effect only in relation to a lease or other contract of tenancy the term of which commences during the period of 5 years from the passing of the Landlord and Tenant (Amendment) Act, 1989, or such longer period as may stand specified for the time being in regulations made by the Minister at any time during the said period of 5 years or during a period standing so specified.
(5) A draft of every regulation proposed to be made under this section shall be laid before each House of the Oireachtas and the regulation shall not be made until a resolution approving of the draft has been passed by each such House.”.
Short title, construction and collective citation.
2.—(1) This Act may be cited as the Landlord and Tenant (Amendment) Act, 1989.
(2) The Landlord and Tenant Acts, 1967 to 1987, and this Act shall be construed together as one Act and may be cited together as the Landlord and Tenant Acts, 1967 to 1989.

Leasú ar alt 13 den Acht um Thiarnaí Talún agus Tionóntaí (Leasú), 1980.
1.—Leasaítear leis seo alt 13 den Acht um Thiarnaí Talún agus Tionóntaí (Leasú), 1980, trí na fo-ailt seo a leanas a chur isteach i ndiaidh fho-alt (2):
“(3) (a) Ní mheasfar gur áitiú chun críocha mhír (a) nó (b) d'fho-alt (1) aon áitiú ag duine nó ag a réamhtheachtaithe i dteideal, faoi léas nó faoi chonradh eile tionóntachta, ar thionóntán i Limistéar Duganna Theach an Chustaim (de réir bhrí alt 41 den Acht Airgeadais, 1986), is tionóntán atá á úsáid bona fide an tráth a dtosaítear á áitiú faoin léas nó faoin gconradh tionóntachta, agus a n-údaraíonn nó a gceanglaíonn an léas nó an conradh sin go sainráite é a úsáid, go hiomlán nó go páirteach chun gníomhaíocht a sheoladh arb éard í nó ar cuid di oibríocht trádála iomchuí de réir bhrí alt 39B (a cuireadh isteach le halt 30 den Acht Airgeadais, 1987, arna leasú le halt 36 den Acht Airgeadais, 1988) den Acht Airgeadais, 1980, nó atá á úsáid bona fide chun ullmhú le haghaidh seoladh gníomhaíochta den sórt sin.
(b) I gcás feidhm a bheith ag an bhfo-alt seo, de bhua mhír
(a), i ndáil le háitiú—
(i) beidh feidhm aige freisin maidir le háitiú faoin léas nó faoin gconradh lena mbaineann tráth ar bith nach mbeidh an tionóntán lena mbaineann á úsáid níos mó chun gníomhaíocht den chineál a dúradh a sheoladh, agus
(ii) beidh feidhm aige i ndáil leis an tionóntán go léir, nó cuid den tionóntán, a áitiú faoi aon léas nó conradh tionóntachta eile a bheidh i bhfeidhm le linn ré iomlán nó cuid de ré an chéad léasa nó conartha tionóntachta a luadh agus a dhéantar tar éis an chéad léas nó chonradh tionóntacha a luadh a dhéanamh.
(4) Ní bheidh éifeacht le fo-alt (3) ach amháin i ndáil le léas nó conradh eile tionóntachta a dtosaíonn a théarma le linn na tréimhse 5 bliana ó dháta rite an Achta um Thiarnaí Talún agus Tionóntaí (Leasú), 1989, nó cibé tréimhse is faide ná sin a bheidh sonraithe de thuras na huaire i rialacháin arna ndéanamh ag an Aire tráth ar bith le linn na tréimshe 5 bliana sin nó le linn tréimhse a bheidh sonraithe amhlaidh.
(5) Déanfar dréacht de gach rialachán a bheartaítear a dhéanamh faoin alt seo a leagan faoi bhráid gach Tí den Oireachtas agus ní dhéanfar an rialachán go dtí go mbeidh rún ag ceadú an dréachta rite ag gach Teach acu sin.”.

2.—(1) Féadfar an tAcht um Thiarnaí Talún agus Tionóntaí (Leasú), 1989, a ghairm den Acht seo.
(2) Déanfar na hAchtanna um Thiarnaí Talún agus Tionóntaí, 1967 go 1987, agus an tAcht seo a fhorléiriú le chéile mar aon Acht amháin agus féadfar na hAchtanna um Thiarnaí Talún agus Tionóntaí, 1967 go 1989, a ghairm díobh le chéile.
