AN tACHT UM DHLÍNSE MHUIRÍ (LEASÚ), 1964

Léiriú.
1.—(1) San Acht seo ciallaíonn “an Príomh-Acht” an tAcht um Dhlínse Mhuirí, 1959.
(2) Déanfar an Príomh-Acht agus an tAcht seo a fhorléiriú le chéile mar aon Acht amháin.
Teorainneacha iascaigh eisiatacha an Stáit a leathnú.
2.—Déantar leis seo fo-alt (1) d'alt 6 den Phríomh-Acht a leasú trí “den líne a bhfuil gach pointe di fad dhá mhíle dhéag farraige ón bpointe is cóngaraí den bhunlíne” a chur in ionad “de theorainn forimeallach na bhfarraigí teorann”.
Stáit a bhfuil cead iascaireachta ag a n-árthaí iascaireachta laistigh de na teorainneacha iascaigh eisiatacha.
3.—(1) Féadfaidh an Rialtas, maidir leis an gcuid sin de theorainneacha iascaigh eisiatacha an Stáit atá lasmuigh den líne a bhfuil gach pointe di fad sé mhíle farraige ón bpointe is cóngaraí den bhunlíne, a shonrú, le hordú, cad iad na Stáit a mbeidh cead ag a n-árthaí iascaireachta iascaireacht a dhéanamh laistigh di.
(2) Féadfaidh an Rialtas, maidir leis an gcuid sin de theorainneacha iascaigh eisiatacha an Stáit atá idir—
(a) an líne a bhfuil gach pointe di fad trí mhíle farraige ón bpointe is cóngaraí den bhunlíne, agus
(b) an líne a bhfuil gach pointe di fad sé mhíle farraige ón bpointe is cóngaraí den bhunlíne, a shonrú, le hordú, cad iad na stáit a mbeidh cead ag a n-árthaí iascaireachta, go dtí—
(i) deireadh na bliana 1965 i limistéir amach ó chodanna den chósta inarb é an marc diathrá an bhunlíne, agus
(ii) deireadh na bliana 1966 i limistéir eile,
iascaireacht a dhéanamh laistigh di.
(3) Féadfaidh feidhm éagsúil a bheith ag ordú faoin alt seo i gcás stát agus árthaí éagsúla agus féadfaidh sé a ordú i gcás aon árthaí áirithe nach cead dóibh iascaireacht a dhéanamh ach ar stoic áirithe éisc nó i mbráití áirithe iascaireachta.
(4) Ní sárú ar an toirmeasc a chuirtear ar iascaireacht ag bád iascaireachta mara coigríche le fo-alt (1) d'alt 222 den Acht Iascaigh (Comhdhlúthú), 1959, iascaireacht faoi réim agus de réir ordú faoin alt seo.
(5) Féadfaidh an Rialtas, le hordú, ordú faoin alt seo a chúlghairm nó a leasú.
(6) Gach ordú a dhéanfar faoin alt seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta, agus má dhéanann ceachtar Teach, laistigh den lá is fiche a shuífidh an Teach sin tar éis an t-ordú a leagan faoina bhráid, rún a rith ag neamhniú an ordaithe sin, beidh an t-ordú ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin ordú.

4.—Déantar leis seo alt 13 den Phríomh-Acht a leasú trí “(a fhéadfaidh siad a chúlghairm nó a leasú le hordú)” a chur isteach i ndiaidh “Féadfaidh an Rialtas, le hordú”.

5.—(1) Féadfar an tAcht um Dhlínse Mhuirí (Leasú), 1964, a ghairm den Acht seo.
(2) Tiocfaidh an tAcht seo i ngníomh cibé lá a cheapfaidh an Rialtas le hordú.
(3) Féadfar na hAchtanna um Dhlínse Mhuirí, 1959 agus 1964, a ghairm den Phríomh-Acht agus den Acht seo le chéile.

MARITIME JURISDICTION (AMENDMENT) ACT, 1964
Interpretation.
1.—(1) In this Act “the Principal Act” means the Maritime Jurisdiction Act, 1959.
(2) The Principal Act and this Act shall be construed together as one Act.
Extension of the exclusive fishery limits of the State.
2.—Subsection (1) of section 6 of the Principal Act is hereby amended by the substitution of “line every point of which is at a distance of twelve nautical miles from the nearest point of the baseline” for “outer limits of the territorial seas”.
States the fishing vessels of which may fish within exclusive fishery limits.
3.—(1) The Government may, with respect to that portion of the exclusive fishery limits of the State which lies outside the line every point of which is at a distance of six nautical miles from the nearest point of the baseline, by order specify the states the fishing vessels of which may fish therein.
(2) The Government may, with respect to that portion of the exclusive fishery limits of the State which lies between—
(a) the line every point of which is at a distance of three nautical miles from the nearest point of the baseline, and
(b) the line every point of which is at a distance of six nautical miles from the nearest point of the baseline,
by order specify the states the fishing vessels of which may,
until—
(i) the end of the year 1965 in areas off parts of the coast where the baseline is low-water mark, and
(ii) the end of the year 1966 in other areas,
fish therein.
(3) An order under this section may apply differently to different states and vessels and may confine fishing by any vessels to particular stocks of fish or particular fishing grounds.
(4) Fishing under and in accordance with an order under this section shall not be a contravention of the prohibition on fishing by means of a foreign sea-fishing boat imposed by subsection (1) of section 222 of the Fisheries (Consolidation) Act, 1959.
(5) The Government may by order revoke or amend an order under this section.
(6) Every order made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling the order is passed by either House within the next twenty-one days on which that House has sat after the order has been laid before it, the order shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Amendment of section 13 of Principal Act.
4.—Section 13 of the Principal Act is hereby amended by the insertion after “The Government may by order” of “(which they may by order revoke or amend)”.
Short title, commencement and collective citation.
5.—(1) This Act may be cited as the Maritime Jurisdiction (Amendment) Act, 1964.
(2) This Act shall come into operation on such day as the Government appoint by order.
(3) The Principal Act and this Act may be cited together as the Maritime Jurisdiction Acts, 1959 and 1964.
