ACHTAÍTEAR AG AN OIREACHTAS MAR A LEANAS:— [EN]

Mínithe.

1.—San Acht seo—

[EN]

ciallaíonn “gnó margalainne beostoic” gnó díola beostoic ar ceant nó ionad, arna oiriúnú chun beostoc a dhíol ar ceant, a chur ar fáil chun díolacháin bheostoic ar ceant nó ar shlí eile a dhéanamh;

ciallaíonn “ceadúnas” ceadúnas faoi alt 3 den Acht seo;

[EN]

ciallaíonn “beostoc” bólacht, caoirigh nó muca;

[EN]

ciallaíonn “an tAire” an tAire Talmhaíochta agus Iascaigh.

Toirmeasc ar mhargalanna beostoic neamhcheadúnaithe.

2.—(1) Ní sheolfaidh duine gnó margalainne beostoic in aon áit mura mbeidh ceadúnas i bhfeidhm de thuras na huaire i leith na háite sin.

(2) Aon duine a sháróidh fo-alt (1) den alt seo beidh sé ciontach i gcion.

[EN]

(3) Tiocfaidh fo-ailt (1) agus (2) den alt seo i ngníomh cibé lá a cheapfaidh an tAire le hordú.

Ceadúnais a dheonú do mhargalanna beostoic.

3.—(1) Ar iarratas ó dhuine nó thar ceann duine a bheartaíonn gnó margalainne beostoic a sheoladh in áit shonraithe i cibé foirm agus a mbeidh cibé sonraí ann a ordóidh an tAire, féadfaidh an tAire, dá rogha féin, ceadúnas ag údarú gnó margalainne beostoic a sheoladh san áit sin a dheonú nó diúltú é a dheonú.

(2) Féadfaidh an tAire, nuair a bheidh sé ag deonú ceadúnais, cibé coinníollacha is oiriúnach leis agus a shonróidh sé sa cheadúnas a chur ag gabháil leis an gceadúnas.

(3) Féadfaidh an tAire, más cuí leis é, coinníoll a ghabhann le ceadúnas a leasú nó a chúlghairm.

[EN]

(4) Má sháraítear coinníoll a ghabhann le ceadúnas beidh sealbhóir an cheadúnais ciontach i gcion.

[EN]

(5) I gcás sealbhóir ceadúnais a bheith ciontach i gcion faoin Acht seo, féadfaidh an tAire, más cuí leis é, an ceadúnas a chúlghairm.

(6) (a) Aon uair a bheartóidh an tAire diúltú ceadúnas a dheonú nó ceadúnas a chúlghairm mar gheall ar sharú ar rialacháin faoi alt 6 den Acht seo lena bhforordaítear aon ábhar a shonraítear i míreanna (e) go (i) d'alt 6 (2) den Acht seo, tabharfaidh sé, sula ndéanfaidh sé amhlaidh, fógra do shealbhóir nó d'iarratasóir an cheadúnais i dtaobh a bhfuil beartaithe aige agus na fáthanna atá leis, agus, má dhéanann an sealbhóir nó an t-iarratasóir, de réir mar a bheidh, aon uiríolla chun an Aire laistigh de sheacht lá tar éis an dáta a thabharfar an fógra, breithneoidh an tAire iad.

(b) Aon uair a bheartóidh an tAire ceadúnas a chúlghairm mar gheall ar shárú ar rialacháin faoi alt 6 den Acht seo lena bhforordaítear aon ábhar a shonraítear i míreanna (e) go (i) d'alt 6 (2) den Acht seo, ní dhéanfaidh an tAire amhlaidh go ceann míosa ó dháta an fógra réamhráite a thabhairt, agus, má tharlaíonn, laistigh de sheacht lá tar éis dáta an fógra réamhráite a thabhairt, go n-iarrfaidh sealbhóir an cheadúnais ar an Aire go ndéanfar fiosrú i dtaobh an ábhair, cuirfidh an tAire faoi deara fiosrú a dhéanamh (mura mbeidh an tAire tar éis a chinneadh, de thoradh uiríolla a rinneadh chuige a bhreithniú, gan an ceadúnas a chúlghairm).

(c) Má dhéantar fiosrú faoin bhfo-alt seo, ní chúlghairfidh an tAire an ceadúnas go dtí go mbreithneoidh sé an tuarascáil ón duine a dhéanfaidh an fiosrú.

(d) Ceapfaidh an tAire duine is abhcóide cleachtach a bhfuil seasamh deich mbliana ar a laghad ag an mbarra aige chun aon fhiosrú a dhéanamh faoin bhfo-alt seo agus beidh cumhacht ag an duine a cheapfar amhlaidh fianaise a ghlacadh faoi mhionn agus údaraítear dó leis seo daoine a chur faoi mhionn agus tabharfaidh sé tuarascáil don Aire i dtaobh a chinneadh ag an bhfiosrú.

(e) Tabharfaidh an tAire don duine a d'iarr go ndéanfaí fiosrú fógra faoi am agus áit an fhiosraithe agus beidh an duine sin i dteideal láithriú ag an bhfiosrú go pearsanta nó trí abhcóide nó aturnae agus fianaise a thabhairt ar aird.

(f) Déanfar cibé luach saothair a shocróibh an tAire le toiliú an Aire Airgeadais a íoc le duine a dhéanfaidh fiosrú faoin bhfo-alt seo.

(7) Aon uair a chúlghairfidh an tAire ceadúnas, cuirfidh sé faoi deara ráiteas ar na fáthanna a bhí aige leis a leagan faoi bhráid gach Tí den Oireachtas.

(8) D'ainneoin aon ní atá san Acht seo, aon duine a sheolann gnó margalainne beostoic in aon áit agus a bhí, díreach roimh dháta an Achta seo a rith, ag seoladh an ghnó sin san alt sin beidh sé i dteideal ceadúnas a fháil i leith na háite sin, má chomhlíontar na rialacháin faoin Acht seo i leith na háite sin.

Díolúine ón Acht.

4.—(1) Féadfaidh an tAire, más cuí leis é, díolúine a thabhairt ó fhorálacha an Achta seo i leith aon ghnó áirithe nó gnó d'aon aicme nó d'aon chineál áirithe a sheoladh.

(2) Ní bheidh feidhm ag an Acht seo maidir le gnó áirithe nó gnó d'aicme nó de chineál áirithe ar tugadh, agus nár tarraingíodh siar, díolúine faoin alt seo ina leith.

(3) Féadfaidh an tAire díolúine faoin alt seo a tharraingt siar aon uair.

[EN]

(4) Cuirfidh an tAire faoi deara sonraí i dtaobh aon díolúine faoin alt seo a thabhairt nó a tharraingt siar a leagan faoi bhráid gach Tí den Oireachtas.

[EN]

Ráiteas bréagach chun ceadúnas a fháil.

5.—Aon duine a dhéanfaidh, chun ceadúnas a fháil dó féin nó do dhuine eile, ráiteas nó uiríoll is eol dó a bheith bréagach nó míthreorach in aon phone ábhartha beidh sé ciontach i gcion.

Rialacháin maidir le margalanna beostoic.

6.—(1) D'fhonn go n-áiritheofar stiúradh cuí ar áiteanna ina seoltar gnó margalainne beostoic agus stiúradh cuí ar ghnóthaí den sórt sin, caighdeáin dhóthanacha oiriúnacha sláinteachais agus tréidliachta maidir leis na háiteanna sin agus ceantanna beostoic sna háiteanna sin agus cóiríocht agus saoráidí a bheidh dóthanach oiriúnach do na ceantanna agus do dhaoine agus do bheostoc ag na ceantanna sin a chur ar fáil, féadfaidh an tAire cibé rialacháin is iomchuí leis a dhéanamh maidir leis na háiteanna agus na gnóthaí sin.

(2) Gan dochar do ghinearáltacht fho-alt (1) den alt seo, féadfar le rialacháin faoin alt seo—

(a) an tslí a fhorordú ina nglacfar le hiontrálacha le haghaidh ceantanna beostoic sna háiteanna sin,

[EN]

(b) a fhoráil nach ndiúltófar iontrálacha le haghaidh ceantanna den sórt sin ach amháin i ndálaí a fhorordaítear sna rialacháin,

[EN]

(c) an tslí a fhorordú ina seolfar ceantanna den sórt sin,

[EN]

(d) a fhoráil go nglacfar iontrálacha le haghaidh ceantanna den sórt sin, agus go seolfar na ceantanna sin, de réir coinníollacha díola a dhréachtaigh úinéir gach áite den sórt sin agus a cheadaigh an tAire agus go ndéanfar na coinníollacha díola a bhaineann le haon áit den sórt sin a thaispeáint in ionad feiceálach is inrochtain ag an bpobal san áit sin,

(e) ceanglais a fhorordú maidir le méid, dearadh, cothabháil, deisiú, glanadh, glaine, aerú, téamh agus soilsiú aon fhoirgnimh ina seoltar ceantanna den sórt sin,

(f) ceanglais a fhorordú maidir leis an gcóiríocht (lena n-áirítear saoráidí níocháin agus áiseanna sláintíochta) a bheidh ar fáil sna háiteanna sin,

(g) ceanglais a fhorordú agus soláthar a dhéanamh i leith scrúdú tréidliachta ar bheostoc ag ceantanna den sórt sin, scrúdú tréidliachta ar mhargalanna beostoic agus maoirseacht thréidliachta ar cheantanna den sórt sin,

(h) foráil i leith údaráis sláinte agus a gcuid oifigeach do dhéanamh cigireachta ar áiteanna den sórt sin agus maoirseacht a dhéanamh ar cheantanna den sórt sin,

(i) riachtanais agus caighdeáin sláinteachais agus tréidliachta a fhorordú d'áiteanna agus do cheantanna den sórt sin.

(3) Aon duine a sháróidh foráil rialachán faoin alt seo beidh sé ciontach i gcion.

[EN]

Cumhachtai oifigeach don Aire.

7.—(1) Chun an tAcht seo a fhorghníomhú, beidh ag oifigeach don Aire an chumhacht chun gach ní nó aon ní acu seo a leanas a dhéanamh, is é sin le rá—

(a) dul isteach, gach tráth réasúnach de ló, in áit ina seoltar gnó margalainne beostoic agus an áit sin a iniúchadh agus a scrúdú;

[EN]

(b) a cheangal doiciméid nach foláir a choimeád de bhun rialachán faoin Acht seo a thabhairt ar aird agus aon cheann acu a iniúchadh, a scrúdú agus cóip a dhéanamh de;

[EN]

(c) cibé scrúdú nó fiosrú a dhéanamh is gá chun a fháil amach an bhfuil forálacha an Achta seo agus na rialachán faoi na hachtacháin atá i bhfeidhm de thuras na huaire maidir le sláinte poiblí, á gcomhlíonadh a mhéid a bhaineann leis an áit;

(d) a cheangal ar dhuine a sheolann gnó margalainne beostoic san áit, nó ar aon duine ag a bhfuil post freagrach bainistí san áit nó, i gcás duine den sórt sin a bheith as láthair, ar aon duine a gheobhaidh sé san áit a mbeidh cúis réasúnach aige chun a chreidiúint go bhfuil sé fostaithe san áit, cibé eolas a thabhairt atá de chumhacht aige a thabhairt faoi cé hé an duine atá ag seoladh gnó margalainne beostoic san áit;

(e) cibé cumhachtaí eile a fheidhmiú is gá chun an tAcht seo a chur in éifeacht.

[EN]

(2) Má mhoillíonn aon duine go toiliúil oifigeach don Aire agus é ag feidhmiú aon chumhachta faoin alt seo, nó má mhainníonn sé déanamh de réir foréilimh ón oifigeach sin de bhun an ailt seo nó aon doiciméad a thabhairt ar aird a cheanglaítear, de bhun rialacháin faoin Acht seo, air a thabhairt ar aird nó má cheileann sé go toiliúil aon eolas a cheanglaítear, de bhun an Achta seo, air a thabhairt measfar cosc a bheith á chur aige ar oifigeach don Aire agus é ag feidhmiú a dhualgas faoin Acht seo.

(3) Má choisctear oifigeach don Aire agus é ag feidhmiú a chumhachtaí nó a dhualgas faoin Acht seo beidh an duine a choiscfidh an t-oifigeach don Aire ciontach i gcion.

[EN]

(4) Tabharfar d'oifigeach don Aire a bheidh ag comhlíonadh feidhmeanna faoin Acht seo deimhniú ar a údarás chun na feidhmeanna sin a chomhlíonadh, agus nuair a bheidh cuairt á thabhairt aige ar áit ina seoltar gnó margalainne beostoic, tabharfaidh sé ar aird, má iarrtar air é, an deimhniú sin don duine a sheolann an gnó sin nó d'aon duine eile ag a bhfuil post freagrach bainistí san áit.

Cionta agus pionóis.

8.—(1)  (a) Gach duine a chabhróidh nó a neartóidh, nó a dhéanfaidh comhcheilg, le haon duine eile, nó a thabharfaidh cúnamh nó comhairle do dhuine eile chun cion faoin Acht seo, a dhéanamh beidh sé ciontach i gcion.

(b) I gcás cion a dhéanamh faoi alt 2 den Acht seo in aon áit maidir le beostoc, agus go bhfuil duine cúisithe i gcion faoin alt seo, i ngeall ar bheostoc a dhíol nó a cheannach nó iad a thairiscint lena ndíol nó lena gceannach san áit sin, is cosaint don duine a chruthú nárbh eol dó tráth an díola, an cheannach nó na tairiscinte, cibé acu é, nach raibh ceadúnas i bhfeidhm maidir leis an áit sin.

(2) I gcás cion faoin Acht seo a dhéanamh ag comhlacht corpraithe nó ag duine a airbheartaíonn gníomhú thar ceann comhlachta chorpraithe nó comhlachta neamhchorpraithe daoine, agus go gcruthófar go ndearnadh amhlaidh é le toiliú nó le ceadú, nó gur urasaíodh a dhéanamh trí aon fhaillí ar thaobh aon duine arb éard é, i gcás comhlachta chorpraithe, stiúrthóir ar an gcomhlacht sin, nó i gcás comhlachta neamhchorpraithe, comhalta de choiste bainistí nó údarás rialaithe eile an chomhlachta sin, beidh an duine sin ciontach i gcion freisin.

(3) Gach duine a dhéanfaidh cion faoin Acht seo dlífear—

[EN]

(a) ar é a chiontú go hachomair, fíneáil nach mó ná céad punt a chur air (agus ina theannta sin, i gcás ciona leanúnaigh, fíneáil bhreise nach mó ná deich bpunt in aghaidh gach lae a leanfar den chion) nó, de rogha na cúirte, príosúnacht ar feadh téarma nach faide ná trí mhí, nó iad araon, a chur air, nó

(b) i gcás ciona faoi alt 2 den Acht seo, ar é a chiontú ar díotáil, fíneáil nach mó ná cúig chéad punt (agus ina theannta sin, i gcás ciona leanúnaigh, fíneáil bhreise nach mó ná caoga punt in aghaidh gach lae a leanfar den chion) nó, de rogha na cúirte, príosúnacht ar feadh téarma nach faide ná sé mhí, nó iad araon, a chur air.

Comhlachtaí neamhchorpraithe daoine a ionchúiseamh.

9.—(1) Féadfar comhlacht neamhchorpraithe daoine a ionchúiseamh i leith ciona faoin Acht seo ionann is dá mba chuideachta é de réir bhrí Acht na gCuideachtaí, 1963, agus beidh feidhm ag forálacha alt 382 den Acht sin maidir le comhlacht neamhchorpraithe daoine ionann is dá mba chuideachta den sórt sin é.

(2) Féadfaidh foráil a bheith i rialacháin a dhéanfaidh an tAire Dlí agus Cirt chun iallach a chur go ndéanfar aon fhíneáil a ghearrfar ar aon chomhlacht den sórt sin ar chiontú, go hachomair nó ar díotáil, i gcion faoin Acht seo, a íoc as aon chuid dá shócmhainní nó dá chistí, cibé áit ina bhfaighfear an céanna.

Ordú agus rialacháin a leagan faoi bhráid Tithe an Oireachtais.

10.—Gach ordú agus rialachán a dhéanfaidh an tAire nó an tAire Dlí agus Cirt faoin Acht seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus má dhéanann ceachtar Teach acu sin, laistigh den lá is fiche a shuífidh an Teach sin tar éis an t-ordú nó an rialachán a leagan faoina bhráid, rún a rith ag neamhniú an ordaithe nó an rialacháin, beidh an t-ordú nó an rialachán ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoi.

11.—Déanfar na caiteachais a thabhoidh an tAire ag riaradh an Achta seo a íoc, a mhéid a cheadóidh an tAire Airgeadais é, as airgead a sholáthróidh an tOireachtas.

LIVESTOCK MARTS ACT, 1967


AN ACT TO PROVIDE FOR THE CONTROL AND REGULATION BY THE MINISTER FOR AGRICULTURE AND FISHERIES OF LIVESTOCK MARTS AND THE SALE OF LIVESTOCK AT SUCH MARTS AND TO PROVIDE FOR OTHER MATTERS CONNECTED WITH THE MATTERS AFORESAID. [17th August, 1967.] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS :— [GA]

Definitions.

1.—In this Act—

business of a livestock mart” means the business of selling livestock by auction or providing, for the holding of sales of livestock by auction or otherwise, a place adapted for the sale of livestock by auction;

[GA]

licence” means a licence under section 3 of this Act;

[GA]

livestock” means cattle, sheep or pigs;

[GA]

the Minister” means the Minister for Agriculture and Fisheries.

[GA]

Prohibition of unlicensed livestock marts.

2.—(1) A person shall not carry on the business of a livestock mart at any place unless there is for the time being a licence in force in respect of that place.

(2) A person who contravenes subsection (1) of this section shall be guilty of an offence.

[GA]

(3) Subsections (1) and (2) of this section shall come into operation on such day as the Minister may appoint by order.

Grant of licences for livestock marts.

3.—(1) On the application of or on behalf of a person who proposes to carry on the business of a livestock mart at a specified place in such form and containing such particulars as the Minister may direct, the Minister may, at his discretion, grant or refuse to grant a licence authorising the carrying on of the business of a livestock mart at that place.

(2) The Minister may, at the time of the granting of a licence, attach to the licence such conditions as he shall think proper and shall specify in the licence.

(3) The Minister may, if he so thinks fit, amend or revoke a condition attached to a licence.

[GA]

(4) Upon breach of a condition attached to a licence the holder of the licence shall be guilty of an offence.

[GA]

(5) Where the holder of a licence is guilty of any offence under this Act, the Minister may, if he so thinks fit, revoke the licence.

[GA]

(6) (a) Whenever the Minister proposes to refuse to grant a licence or to revoke a licence because of a contravention of regulations under section 6 of this Act prescribing any matter specified in paragraphs (e) to (i) of section 6 (2) of this Act, he shall, before doing so, notify the holder of or the applicant for the licence of his intention and of the reasons therefor, and, if any representations are made to the Minister within seven days after the date of the giving of the notification by the holder or applicant, as the case may be, the Minister shall consider them.

(b) Whenever the Minister proposes to revoke a licence because of a contravention of regulations under section 6 of this Act prescribing any matter specified in paragraphs (e) to (i) of section 6 (2) of this Act, the Minister shall not do so until the expiration of one month after the date of the giving of the notification aforesaid, and, if, within seven days after the giving of the notification aforesaid, the holder of the licence makes a request to the Minister for the holding of an inquiry in relation to the matter, the Minister shall cause an inquiry to be held (unless, as result of the consideration of representations made to him, the Minister has decided not to revoke the licence).

(c) Where an inquiry is held under this subsection, the Minister shall not revoke the licence until he has considered the report of the person holding the inquiry.

[GA]

(d) The Minister shall appoint a person who is a practising barrister of at least ten years' standing to hold any inquiry under this subsection and the person so appointed shall have power to take evidence on oath which he is hereby authorised to administer and shall make a report to the Minister of his findings at the inquiry.

[GA]

(e) The Minister shall give to the person who requested the holding of the inquiry notice of the time and place of the holding of the inquiry and the person shall be entitled to appear at the inquiry personally or by counsel or solicitor and to adduce evidence.

[GA]

(f) There shall be paid to a person holding an inquiry under this subsection such remuneration as the Minister, with the consent of the Minister for Finance, may fix.

[GA]

(7) Whenever the Minister revokes a licence, he shall cause a statement of his reasons for doing so to be laid before each House of the Oireachtas.

[GA]

(8) Notwithstanding anything contained in this Act, a person who carries on the business of a livestock mart at any place and who, immediately before the passing of this Act, carried on that business at that place, shall, if in relation to the place, the regulations under this Act are complied with, be entitled to be granted a licence in respect of the place.

Exemption from Act.

4.—(1) The Minister may, if he so thinks fit, grant exemption from the provisions of this Act in respect of the carrying on of any particular business or business of any particular class or kind.

(2) This Act shall not apply in relation to a particular business or business of a particular class or kind in respect of which an exemption under this section has been granted and has not been withdrawn.

(3) An exemption under this section may be withdrawn at any time by the Minister.

[GA]

(4) The Minister shall cause particulars of any grant or withdrawal of an exemption under this section to be laid before each House of the Oireachtas.

False statement to obtain licence.

5.—A person who, for the purpose of obtaining a licence for himself or another person, makes a statement or representation which is to his knowledge false or misleading in a material respect shall be guilty of an offence.

Regulations in relation to livestock marts.

6.—(1) The Minister may, for the purpose of ensuring the proper conduct of places where the business of a livestock mart is carried on and the proper conduct of such businesses, adequate and suitable hygienic and veterinary standards in relation to such places and auctions of livestock at such places and the provision of adequate and suitable accommodation and facilities for such auctions and for persons and livestock at such auctions, make such regulations as he thinks appropriate in relation to such places and such businesses.

(2) Without prejudice to the generality of subsection (1) of this section, regulations under this section may—

(a) prescribe the manner in which entries for auctions of livestock at such places shall be received,

[GA]

(b) provide that entries for such auctions shall not be refused except in circumstances prescribed in the regulations,

[GA]

(c) prescribe the manner in which such auctions shall be conducted,

(d) provide that the receipt of entries for and the conduct of such auctions shall be carried out in accordance with conditions of sale drawn up by the owner of each such place and approved of by the Minister and that the conditions of sale relating to any such place shall be displayed in a prominent position which is accessible to the public at that place,

(e) prescribe requirements as to the size, design, maintenance, repair, cleansing, cleanliness, ventilation, heating and lighting of any buildings in which such auctions are held,

[GA]

(f) prescribe requirements as to the accommodation (including washing facilities and sanitary conveniences) provided at such places,

[GA]

(g) prescribe requirements as to and provide for the veterinary examination of livestock at such auctions, the veterinary inspection of livestock marts and the veterinary supervision of such auctions,

[GA]

(h) provide for the inspection of such places and the supervision of such auctions by health authorities and their officers,

[GA]

(i) prescribe hygienic and veterinary requirements and standards for such places and such auctions.

[GA]

(3) A person who contravenes a provision of regulations under this section shall be guilty of an offence.

[GA]

Powers of officers of Minister.

7.—(1) An officer of the Minister shall, for the purposes of the execution of this Act, have power to do all or any of the following things, that is to say—

(a) to enter, inspect and examine at all reasonable times by day a place where the business of a livestock mart is carried on;

[GA]

(b) to require the production of any documents, required to be kept in pursuance of regulations under this Act, and to inspect, examine and copy any of them;

[GA]

(c) to make such examination and inquiry as may be necessary to ascertain whether the provisions of this Act and the regulations thereunder and the enactments for the time being in force relating to public health are complied with, so far as respects the place;

[GA]

(d) to require the person who carries on the business of a livestock mart at the place or any person holding a responsible position of management at the place or, in the absence of any such person, any person whom he finds in the place and whom he has reasonable cause to believe to be employed in the place to give such information as it is in his power to give as to who is carrying on the business of a livestock mart in the place;

[GA]

(e) to exercise such other powers as may be necessary for carrying this Act into effect.

[GA]

(2) If any person wilfully delays an officer of the Minister in the exercise of any power under this section, or fails to comply with the requisition of such an officer in pursuance of this section, or to produce any document which he is required in pursuance of regulations under this Act to produce, or wilfully withholds any information he is required in pursuance of this Act to give, that person shall be deemed to obstruct an officer of the Minister in the execution of his duties under this Act.

(3) Where an officer of the Minister is obstructed in the execution of his powers or duties under this Act the person obstructing the officer of the Minister shall be guilty of an offence.

(4) An officer of the Minister performing functions under this Act shall be furnished with a certificate of his authorisation to perform those functions, and when visiting a place where the business of a livestock mart is carried on shall, if so required, produce the said certificate to the person who carries on such business or any other person holding a responsible position of management at the place.

Offences and punishments.

8.—(1) (a) Every person who attempts or aids, abets, assists, counsels or procures another person, or conspires with another person, to commit an offence under this Act shall be guilty of an offence.

(b) Where an offence under section 2 of this Act is committed at any place in relation to livestock and a person is, by reason of having sold or bought or offered to sell or buy the livestock at that place, charged with an offence under this section, it shall be a defence for the person to prove that he did not know that there was not, at the time of the sale, purchase or offer, as the case may be, a licence in force in respect of that place.

(2) Where an offence under this Act is committed by a body corporate or by a person purporting to act on behalf of a body corporate or an unincorporated body of persons, and is proved to have been so committed with the consent or approval of, or to have been facilitated by any default on the part of any person being, in the case of a body corporate, a director thereof, or, in the case of an unincorporated body, a member of the committee of management or other controlling authority thereof, that person shall also be guilty of the offence.

(3) Every person who commits any offence under this Act shall be liable—

[GA]

(a) on summary conviction, to a fine not exceeding one hundred pounds (together with, in the case of a continuing offence, a further fine not exceeding ten pounds for every day on which the offence is continued) or, at the discretion of the court, to imprisonment for a term not exceeding three months, or to both the fine and the imprisonment, or

[GA]

(b) in the case of an offence under section 2 of this Act, on conviction on indictment, to a fine not exceeding five hundred pounds (together with, in the case of a continuing offence, a further fine not exceeding fifty pounds for every day on which the offence is continued) or, at the discretion of the court, to imprisonment for a term not exceeding six months or to both the fine and the imprisonment.

Prosecution of unincorporated bodies of persons.

9.—(1) An unincorporated body of persons may be prosecuted for an offence under this Act as if it were a company within the meaning of the Companies Act, 1963, and the provisions of section 382 of that Act shall apply in relation to an unincorporated body of persons as if it were such a company.

(2) Provision may be made by regulations made by the Minister for Justice for enforcing the payment of any fine imposed on any such body on conviction, whether summarily or on indictment, of an offence under this Act, out of any of its assets or funds, wherever found.

Laying of order and regulations before Houses of Oireachtas.

10.—Every order and regulation made by the Minister or the Minister for Justice under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the order or regulation is passed by either such House within the next subsequent twenty-one days on which that House has sat after the order or regulation is laid before it, the order or regulation shall be annulled accordingly but without prejudice to the validity of anything previously done thereunder.

Expenses.

11.—The expenses incurred by the Minister in the administration of this Act shall to such extent as may be sanctioned by the Minister for Finance be paid out of moneys provided by the Oireachtas.

Short title.

12.—This Act may be cited as the Livestock Marts Act, 1967.
