AN tACHT IOMPAIR, 1983

Mínithe.
1.—San Acht seo—
ciallaíonn “Acht 1950” an tAcht Iompair, 1950;
ciallaíonn “Acht 1981” an tAcht Iompair, 1981.
An Bord d'fháil airgid ar iasacht chun críocha caipitiúla.
2.—Cuirtear an méid seo a leanas in ionad alt 5 (2) den Acht Iompair, 1964 (a cuireadh isteach le hAcht 1981):
“(2) Ní mó ná £230,000,000 comhiomlán na n-iasachtaí faoin alt seo a bheidh gan aisíoc aon tráth áirithe.”.
Ráthaíochtaí i leith airgead áirithe is iníoctha ag an mBord.
3.—(1) Cuirtear an méid seo a leanas in ionad alt 2 (2) den Acht um Ráthaíochtaí Stáit (Iompar), 1962 (a cuireadh isteach le hAcht 1981):
“(2) Ní dhéanfaidh an tAire na cumhachtaí a thugtar le fo-alt (1) den alt seo nó le halt 4 (1) den Acht Iompair, 1974, a fheidhmiú i slí gur mó ná £230,000,000 méid, nó méid comhiomlán, na príomhshuime a dhlífidh sé a íoc aon tráth áirithe de bhun ráthaíochta nó ráthaíochtaí faoin alt seo nó faoi alt 4 den Acht Iompair, 1974 (nó faoin dá alt sin), a bheidh i bhfeidhm de thuras na huaire, mar aon le méid na príomhshuime (más ann) a bheidh íoctha aige roimhe sin de bhun aon ráthaíochtaí den sórt sin agus nár aisíocadh.”.

4.—Cuirtear an méid seo a leanas in ionad alt 28 (1) (c) d'Acht 1950 (a cuireadh isteach le hAcht 1981):
“(c) Ní dhéanfaidh an Bord in aon chás a chumhachtaí faoi mhír (a) den fho-alt seo a fheidhmiú ar shlí gur mó ná £40,000,000 aon tráth a fhéichiúnas iomlán i leith iasachta sealadaí.”.
Ráthaíocht Stáit le hiasachtaí sealadacha a gheobhaidh an Bord.
5.—Cuirtear an méid seo a leanas in ionad alt 30 (1) (b) d'Acht 1950 (a cuireadh isteach le hAcht 1981):
“(b) Ní dhéanfaidh an tAire Airgeadais na cumhachtaí a thugtar dó leis an bhfo-alt seo a fheidhmiú ar shlí gur mó ná £40,000,000 méid, nó méid comhiomlán, na príomhshuime a dhlífidh sé a aisíoc aon tráth áirithe ar scór aon ráthaíochta nó aon ráthaíochtaí faoin bhfo-alt seo a bheidh i bhfeidhm de thuras na huaire, mar aon le méid na príomhshuime (más ann) a bheidh íoctha roimhe sin ag an Aire sin ar scór aon ráthaíochta faoin bhfo-alt seo agus nach mbeidh aisíoctha ag an mBord.”.
Caiteachais.
6.—Déanfar na caiteachais a thabhófar ag riaradh an Achta seo a íoc as airgead a sholáthróidh an tOireachtas.

7.—Féadfar an tAcht Iompair, 1983, a ghairm den Acht seo.

TRANSPORT ACT, 1983
Definitions.
1.—In this Act—
“the Act of 1950” means the Transport Act, 1950;
“the Act of 1981” means the Transport Act, 1981.
Borrowing by Board for capital purposes.
2.—The following is substituted for section 5 (2) of the Transport Act, 1964 (inserted by the Act of 1981):
“(2) The aggregate at any one time of borrowings under this section which have not been repaid shall not exceed £230,000,000.”.
Guarantees in respect of certain moneys payable by Board.
3.—The following is substituted for section 2 (2) of the State Guarantees (Transport) Act, 1962 (inserted by the Act of 1981):
“(2) The Minister shall not so exercise the powers conferred by subsection (1) of this section or by section 4 (1) of the Transport Act, 1974, that the amount, or the aggregate amount, of principal which he may at any one time be liable to pay pursuant to a guarantee or guarantees under this section or section 4 of the Transport Act, 1974 (or under both those sections), and for the time being in force, together with the amount of principal (if any) which he has previously paid pursuant to any such guarantees and which has not been repaid, exceeds £230,000,000.”.
Temporary borrowing powers of Board.
4.—The following is substituted for section 28 (1) (c) of the Act of 1950 (inserted by the Act of 1981):
“(c) The Board shall not in any case so exercise its powers under paragraph (a) of this subsection that its total indebtedness in respect of temporary borrowing exceeds at any one time £40,000,000.”.
State guarantee of temporary borrowings by Board.
5.—The following is substituted for section 30 (1) (b) of the Act of 1950 (inserted by the Act of 1981):
“(b) The Minister for Finance shall not so exercise the powers conferred on him by this subsection that the amount, or aggregate amount, of principal which he may at any one time be liable to repay on foot of any guarantee or guarantees under this subsection for the time being in force, together with the amount of principal (if any) which that Minister has previously paid on foot of any guarantee under this subsection and has not been repaid by the Board, exceeds £40,000,000.”.
Expenses.
6.—The expenses incurred in the administration of this Act shall be paid out of moneys provided by the Oireachtas.
Short title.
7.—This Act may be cited as the Transport Act, 1983.
